Permit for temporary residence

With each application you must enclose a set of documents that are required by law. If you do not possess all the documents on the day of submitting the application, you can submit them later. Find out which documents to enclose with the application for a temporary residence permit, depending on the purpose of your stay in Poland.

Work

Submit to the office:

– 2 copies of the application for a temporary residence permit (2 originals or the original and a copy with original signatures)

– 4 up-to-date colour photographs, 35 x 45 mm in size

– 2 copies of a valid travel document (all written pages – stamps, entries). If you do not possess a travel document, in particularly justified cases you may submit copies of another identity document

– confirmation of payment of the stamp duty to the office’s account

Attachment No. 1 (filled in and signed legibly by the employer)

– documents confirming an assured place of residence in Poland (e.g. lease agreement)

– documents confirming a stable and regular source of income (e.g. employment contract/ contract of mandate) Ensure that you have an adequate income >>>

– documents confirming possession of health insurance. Verify with which documents you can prove that you are insured >>

– a work permit or information from the staroste on the lack of possibility to meet the staffing needs.  In case you are exempt from the obligation to have a work permit – a document confirming that you are entitled to such an exemption (e.g. a diploma from a Polish university)

– PIT tax return for the previous year and confirmation of its submission to the tax office

– certificate of no tax arrears

– a declaration made under penalty of law regarding the number of your dependants

* Additionally, if you act as a proxy or member of the management board of a legal entity subject to registration in the Register of Entrepreneurs, you must include:

– documents confirming the achievement in the tax year preceding the submission of the application of an income not less than twelve times the current average monthly salary on the day of submitting the application, e.g. CIT 8 of the company for the previous year along with a proof of sending to the tax office, accounting documents confirming the current financial result of the company or

– documents confirming the permanent and full-time employment of at least two employees who are Polish citizens or migrants with special residence statuses (e.g. with permanent residence, refugee status, EU citizenship, etc.) for at least one year before submitting the application

– documents proving that they have the means to fulfil these conditions in the future – in particular those that would contribute to increased investment, technology transfer, the introduction of beneficial innovations or the creation of new jobs

Work in a highly skilled occupation (Blue Card)

Submit to the office:

– 2 copies of the application for a temporary residence permit (2 originals or 1 original plus copy with original signatures)

– 4 up-to-date colour photographs, 35 x 45 mm in size

– 2 copies of a valid travel document (all written pages – stamps, entries). If you do not possess a travel document, in particularly justified cases you may submit copies of another identity document.

– confirmation of payment of the stamp duty to the office’s account,

Attachment No. 2

– documents confirming an assured place of residence in Poland (e.g. lease agreement)

– documents confirming a stable and regular source of income (e.g. employment contract/contract of mandate – concluded for a period of at least 1 year, with remuneration of not less than the equivalent of 150% of the amount of average remuneration in the national economy in the year preceding conclusion of the agreement)

– evidence of higher professional qualifications (i.e. university degree)

– documents confirming possession of health insurance

– a work permit or information from the staroste on the lack of possibility to meet the staffing needs.  If you are exempt from the obligation to have a work permit – a document confirming that you are entitled to such an exemption (e.g. a diploma from a Polish university)

– PIT tax return for the previous year and confirmation of its submission to the tax office

Seasonal work

Submit to the office:

– 2 copies of the application for a temporary residence permit (2 originals or 1 original plus copy with original signatures)

– 4 up-to-date colour photographs, 35 x 45 mm in size

– 2 copies of a valid travel document (all written pages – stamps, entries). If you do not possess a travel document, in particularly justified cases you may submit copies of another identity document.

– confirmation of payment of the stamp duty to the office’s account

– documents confirming an assured place of residence in Poland (e.g. lease agreement, lending agreement, registration, hotel reservation)

– documents confirming a stable and regular source of income (e.g. employment contract/contract of mandate)

– documents confirming possession of health insurance

– a seasonal work permit or an extension of a seasonal work permit, valid beyond your period of residence specified in your visa or your period of residence under visa-free regime

Work of a posted worker

Submit to the office:

– 2 copies of the application for a temporary residence permit (2 originals or 1 original plus copy with original signatures)

– 4 up-to-date colour photographs, 35 x 45 mm in size

– 2 copies of a valid travel document (all written pages – stamps, entries). If you do not possess a travel document, in particularly justified cases you may submit copies of another identity document.

– a secondment document specifying the period of secondment and the amount of remuneration

– certificate of no tax arrears

– work permit

Conduct of business activities

Submit to the office:

– 2 copies of the application for a temporary residence permit (2 originals or 1 original plus copy with original signatures)

– 4 up-to-date colour photographs, 35 x 45 mm in size

– 2 copies of a valid travel document (all written pages – stamps, entries). If you do not possess a travel document, in particularly justified cases you may submit copies of another identity document.

Attachment No. 1 (completed and signed legibly by your employer), but only if the purpose of your residence is to perform work by acting as a member of the management board of a limited liability company or joint-stock company which you have established or whose shares you have subscribed for or acquired, or to manage the affairs of a limited partnership or limited joint-stock partnership by a general partner, or to act as a proxy.

– declaration under penalty of law on the number of dependants

– certificate of non-liability for company taxes

 – articles of association

 – the company’s balance sheet, including an updated profit and loss account

 – business questionnaire

 – documents confirming the achievement in the tax year preceding the submission of the application of an income not less than twelve times the current average monthly salary on the day of submitting the application, e.g. CIT 8 of the company for the previous year along with a proof of sending to the tax office, accounting documents confirming the current financial result of the company or

Residence with a foreigner family member

Submit to the office:

– 2 copies of the application for a temporary residence permit (2 originals or 1 original plus copy with original signatures)

– 4 up-to-date colour photographs, 35 x 45 mm in size

– 2 copies of a valid travel document (all written pages – stamps, entries). If you do not possess a travel document, in particularly justified cases you may submit copies of another identity document 

– confirmation of payment of the stamp duty to the office’s account

– documents confirming an assured place of residence in Poland (e.g. lease agreement)

– documents confirming possession of health insurance.

– documents proving the degree of relationship with the family member to whom you are joining (birth certificate, marriage certificate)

– documents confirming that the person you are joining holds the required residence permit in Poland (e.g. a residence card, a decision on granting a residence permit)

– documents confirming a stable and regular source of income sufficient to cover the costs of living for oneself and one’s family members

– declaration under penalty of law on the number of dependants

– in the case of spouses, documents proving cohabitation and household management, e.g. joint photos of different meetings, joint trips, joint contracts or bank accounts, etc. (in paper form)

* NOTE: if your application for a permit was submitted before the expiry of 6 months from the date on which the family member you are joining obtained refugee status or subsidiary protection, you are NOT REQUIRED to present :

– health insurance,

– a source of stable and regular income,

– confirmation of residence in Poland.

Residence with a family member – Polish citizen

Submit to the office:

– 2 copies of the application for a temporary residence permit (2 originals or 1 original plus copy with original signatures)

– 4 up-to-date colour photographs, 35 x 45 mm in size

– 2 copies of a valid travel document (all written pages – stamps, entries). If you do not possess a travel document, in particularly justified cases you may submit copies of another identity document.

– confirmation of payment of the stamp duty to the office’s account

– an up-to-date copy of your marriage certificate (issued not more than 3 months before submission of the application)

– copy of spouse’s identity card

– birth certificate of the child/children (if there are joint children)

– if the application is submitted on behalf of a child – documents confirming that the parent who is married to a Polish citizen has a residence permit (e.g. a residence card, a decision on granting a permit)

– in the case of spouses, documents proving cohabitation and household management, e.g. joint photos of different meetings, joint trips, joint contracts or bank accounts, etc. (in paper form)

Full-time studies

Submit to the office:

– 2 copies of the application for a temporary residence permit (2 originals or 1 original plus copy with original signatures)

– 4 up-to-date colour photographs, 35 x 45 mm in size

– 2 copies of a valid travel document (all written pages – stamps, entries). If you do not possess a travel document, in particularly justified cases you may submit copies of another identity document. 

– confirmation of payment of the stamp duty to the office’s account

– documents confirming an assured place of residence in Poland (e.g. lease agreement)

– certificate from the university about admission to studies or about continuation of studies/preparatory course for studies in Polish language

– a certificate from the university confirming the amount of tuition fees for the whole academic year and the winter semester of the following year

– evidence of payment of tuition fees, indicating the date of payment of tuition fees or part thereof (in the case of commencement or continuation of paid studies)

– in case of continuation of studies – a printout of the student’s periodic performance form, a copy of all the pages of the student’s record

 – documents evidencing the cost of living, including fixed utility charges, energy, gas, water, sewage and refuse collection fees (e.g. a tenancy agreement and the last gas, electricity and administrative rent bill, or a certificate from the student accommodation confirming the amount paid)

– documents confirming sufficient financial means to cover the costs of living in Poland, costs of education and costs of accommodation, e.g. bank statement, credit card statement, document confirming the award of a scholarship

Part-time studies

Submit to the office:

– 2 copies of the application for a temporary residence permit (2 originals or 1 original and a copy with original signatures)

– 4 up-to-date colour photographs, 35 x 45 mm in size

Polish university graduate looking for a job

– documents confirming the possession of financial means for covering the costs of living and return, e.g. bank statement, bank account history confirming the regularity of payments into the account.  If the costs of living of the graduate are covered by a family member who lives in Poland, it is possible to present his/her statement of financial support along with a contract of employment or other documents confirming his/her income. – an agreement to host a researcher in order to conduct scientific research or development work, concluded with a scientific unit in Poland

– a written statement by the researcher undertaking to bear the costs related to the issuance and enforcement of the return decision

Scientist seeking employment after completing research

– a photocopy of an ICT residence card issued by another EU country

– when practising a regulated profession, evidence of formal qualifications to exercise such a profession

– documents proving the possibility of returning to a non-EU based parent employer at the end of an intra-corporate transfer

– a written contract on the basis of which work will be performed or a document issued by the parent employer constituting the basis for an intra-corporate transfer (the amount of remuneration specified in the contract may not be lower than 70% of the average gross monthly salary in the national economy as published by the President of the Central Statistical Office)

Long-term mobility of the researcher

– 2 copies of the application for a temporary residence permit (2 originals or 1 original plus copy with original signatures)

– 4 up-to-date colour photographs, 35 x 45 mm in size

– 2 copies of a valid travel document (all written pages – stamps, entries). If you do not possess a travel document, in particularly justified cases you may submit copies of another identity document

– confirmation of payment of the stamp duty to the office’s account

– documents confirming possession of health insurance

– documents confirming an assured place of residence in Poland (e.g. lease agreement)

– a photocopy of a residence card or long-stay visa with the indication “researcher” issued by another EU country

 – an agreement to host a researcher in order to conduct scientific research or development work, concluded with a scientific unit based in Poland

  – a written statement by the scientific unit in which it undertakes to bear the costs related to the issuance and enforcement of the decision to oblige the foreigner to return

– documents confirming sufficient financial means to cover the costs of living in Poland (monthly financial means, after deducting the means to cover the costs of living, should be higher than PLN 528 for a family members or PLN 701 for a person running a household alone) and the return journey to the country of residence (PLN 200 in the case of a country neighbouring Poland, PLN 500 in the case of the European Union, PLN 2500 in the case of a country outside the European Union) and the costs of living, e.g. a bank statement, a credit card statement, a document confirming the scholarship award.

Long-term mobility of a researcher’s family member

– a photocopy of a residence card or long-stay visa with the indication “researcher”, issued by another EU country

Short-term residence due to special circumstances

– documents confirming the circumstances requiring the short-term residence on the territory of the Republic of Poland (e.g. a summons to appear in person before a court, a public prosecutor’s office or a confirmation that you have an exceptional personal situation due to which you cannot leave Poland or a confirmation that your presence here is necessary for the interests of Poland)
