Being representatives of social organisations, we strongly disagree with the hostile takeover of the Commissioner for Human Rights’ office by the ruling parliamentary majority. We do not accept that our rights and freedoms are de facto decided by Julia Przyłębska’s politically dependent tribunal, that its decisions disregard the fundamental principles of procedural fairness, including the independence and impartiality of judges.
The view adopted few days ago by the Court is yet another example of the seizure of the state by the party in power, the undermining of the foundations of democracy and the circumvention of the Constitution according to the principle: after us the deluge.
The provisions of the Constitution of the Republic of Poland do not preclude the continuation of the Commissioner for Human Rights’ mission until a successor has been elected. Indeed, the values enshrined in the preamble to the Constitution and its constitutional principles, such as continuity in the functioning of the public authorities, citizens’ confidence in the state and the concern that citizens’ fundamental rights and freedoms not be violated, require that this office be held in an independent manner by a person who has previously obtained a democratic mandate until a successor is elected.
The opposing standard adopted by Julia Przyłębska’s tribunal means that we are all losing our defender. The persons most affected by this change will be those for whom the office of the Commissioner for Human Rights has been the main bastion and advocate of their rights in recent years. It will therefore be felt most intensely by those who, for various reasons, are at risk of exclusion: people from villages, the elderly, people with disabilities, people in crisis of homelessness, members of minorities, especially sexual minorities, people in detention centres. In 2020 alone, the Commissioner for Human Rights received more than 72 000 requests for protection in individual cases. With these recent events, Poland will also lose an important centre for speaking up for women’s rights.
As a civil society, we are also losing an important arena for social debate, a place to raise forgotten or neglected issues, to forge new ideas and solutions. One of the last platforms where people with different views could meet, respectfully seeking common solutions to mutually recognised problems.
The Court’s decision also poses a direct threat to several hundred people working in the Office of the Commissioner for Human Rights. There is a risk of staff purges, an attack on their independence and behaviour similar to that seen in other institutions taken over in a similar way. During these difficult times, we sympathise with everyone working in the Commissioner’s Office. We would like to thank them all, as well as the outgoing Commissioner, for their hard work in upholding human rights in Poland.
Simultaneously, we demand that the election of a new Commissioner for Human Rights should take place in accordance with the provisions of the Constitution. We will consider any attempt to appoint an acting Commissioner bypassing the Sejm and the Senate as a violation of the provisions of the Constitution
Therefore, we call on the international community to monitor what the ruling parliamentary majority is doing in this regard.
