SIP proposes to introduce a file reading room at the Office for Foreigners

Association for Legal Intervention proposed to introduce a file reading room or to designate more rooms and hours for reviewing case records at the Office for Foreigners (Department for Legalisation of Stay).

Currently it is not possible to make an appointment to review case records. In order to review case records a foreigner has to make an appointment through an internet calendar. As of today there are no available places until the end of November 2019. The calendar is inactive for future date. In practice it leads to the deprivation of a right to review case file and present evidence before the decision is made.

Public institutions have to organize their work as to allow for the actual and not hypothetical enjoyment of rights by the parties to the proceedings. In the opinion of the Association for Legal Intervention current system is insufficient and violates basic rights in the administrative proceedings.

Introduction of our proposals could better protect the rights of foreigners.
